An independent delivery driver contract is an agreement between a business and a self-employed driver that sets out the delivery services, how the driver is paid (per delivery, per route or per mile), who provides and insures the vehicle, who covers fuel and expenses, the driver's independent-contractor status and tax responsibilities, confidentiality, and how either side can end the arrangement.

Independent Delivery Driver Contract: common questions

What should an independent delivery driver contract include?

The services and delivery area, the pay rate and when it's paid, who provides and insures the vehicle, who covers expenses, the driver's independent-contractor status and tax responsibilities (W-9/1099), confidentiality of customer data, liability for damaged goods, and how either party can end the agreement.

Does a contract make a driver an independent contractor?

No — the label in the contract helps, but classification depends on how the relationship actually works (control over hours, routes, tools, and freedom to work for others) and on state tests such as California's ABC test. The template is written to support contractor status, but you must operate that way in practice.

Does a delivery driver need commercial insurance?

Often yes. Many personal auto policies exclude driving for pay. Drivers usually need a business-use endorsement or a commercial policy; the template requires the driver to confirm their cover.

How are independent drivers paid?

Commonly per delivery, per route, per hour or per mile, paid weekly or fortnightly with no tax withheld. The driver handles their own taxes and the business may issue a 1099.

Is this legal advice?

No. This is a template. Worker-classification rules vary by state and can carry penalties, so take advice if you rely heavily on contract drivers.
